The Right To Produce — Restoring Economic Sovereignty

As we witness the tightening of the “Administrative Stewardship” over the American economy in 2026, The Scriptorium of the People turns its focus to a pillar of liberty often buried under layers of bureaucratic code: The Right to Private Exchange.

While the Constitution does not explicitly list “the right to start a business” or “the right to trade labor for value,” the 9th Amendment Project (9AP) identifies these as quintessential Other Rights Retained by the People. Following the logic of the 9AP Strategic Roadmap (Milestone 4), we assert that the right to produce is a property right in one’s own time and talent—a jurisdiction where the State is a trespasser, not a landlord.

In the current regulatory climate, we have moved from a society of “everything is permitted unless forbidden” to a “Permit-to-Exist” model. Whether it is the arbitrary occupational licensing requirements currently stifling Florida’s independent contractors or the federal push for Central Bank Digital Currencies (CBDC), the message is clear: your ability to engage in commerce is a privilege granted by the State.

The 9th Amendment was designed specifically to prevent this. As Justice Bushrod Washington noted in Corfield v. Coryell, the “privileges and immunities” of citizens include the right to reside in any state for the purposes of trade and the “enjoyment of life and liberty, with the right to acquire and possess property.” To require a State “license” for a common calling is a disparagement of the inherent Right to Produce.

The Scriptorium is currently monitoring the 2026 federal “Financial Inclusion” initiatives, which many fear are a Trojan horse for a programmable CBDC. If the State can monitor, freeze, or “expire” your currency based on social credit or political alignment, the Right to Private Exchange is effectively dead.

Economic liberty is the foundation of all other liberties. A man who cannot buy, sell, or produce without a digital handshake from the State is not a citizen; he is a tenant. Under the 9th Amendment Project, we hold that any financial architecture that removes the anonymity of physical cash or its digital equivalent is an unconstitutional incursion into the Personal Jurisdiction.

  • The “Common Calling” Standard: We advocate for the repeal of all occupational licenses that do not have a direct, scientifically proven link to public safety.
  • Financial Decentralization: We support the right to utilize alternative mediums of exchange—including gold, silver, and decentralized cryptocurrencies—as a protected 9th Amendment activity.
  • Ending Regulatory Takings: Any regulation that renders a private business unprofitable through “administrative friction” must be viewed as a 5th Amendment taking, protected by the 9th Amendment’s presumption of liberty.
